A lawsuit has been filed on EA for having broken the promise of including a complete Battlefield 1943 title on a Blu-ray disc.

Lawsuit filed on Electronic Arts for failing to keep Battlefield 3 promise

Playstation 3 owners have filed a class action lawsuit on Electronic Arts, on the grounds that the company has failed to provide extra promised content for its latest title, Battlefield 3. PS3 copies of Battlefield 3 were supposed have been incorporated with the best selling Playstation Network title, Battlefield 1943. But the promise failed to materialize, leaving a number of players disappointed and frustrated, leading to the class action suit.

Publisher’s Trying To Increase Sales

Numerous publishers are resorting to bundling copies of the recent games with earlier versions of the games in order to boost sales. On that note, THQ recently announced that Saints Row 2 is being made available on the purchase of the third game of Saints Row. EA too has regularly announced from time to time that it will include extra games in their latest releases.

Story behind the class suit

In June, at a video game conference, the Executive Producer of DICE, Patrick Bach, announced that the PS3 version of Battlefield 3 would include a complete Battlefield 1943 title on a Blu-ray disc. But during the launch of the Battlefield 3 in October, this promised content exclusive for PS3 was however missing without any formal announcement explaining the omission.
In response to a customer inquiry on October 25, the very first acknowledgement of this issue came officially from the @Battlefield twitter account. The official tweet stated that EA has made all of the Battlefield 3 expansions available to the customers at the earliest, in the lieu of 1943 being available on disk for PS3 users. This exclusivity had however been announced already back in September. While a few customers might have been content with the given explanation, with a few probably never having known about the Battlefield 1943 offer made by EA, many other customers are aggrieved and are taking EA to court on the matter.
The lawsuit that was filed by a law firm called Edelson McGuire, which alleged that EA has misled and thus profited from their customers by making a false promises. Kotaku reported that the plaintiffs involved in the lawsuit are simply looking to receive a free copy of Battlefield 1943 that had been promised to them.
